Re: Lawsuit against EZ Bright Corporation seeking injunction, etc. of infringement of LumiNova® Patent.

As of November 2nd, 2005, Nemoto & Co., Ltd. (Plaintiff) has entered a court arbitrated settlement with EZ Bright Corporation (13-14 Ishizu-Minamimachi, Neyagawa-shi, Osaka, Mr. Noritaka Kawabe, President, Defendant) concerning the lawsuit filed at the Tokyo District Court, "Heisei 16 (2004) (wa) No. 774", seeking injunction, etc. of infringement of Japanese Patent No. 2,543,825 covering LumiNovaR, a long afterglow phosphorescent phosphor.
According to the settlement, the Defendant, acknowledging the infringement of the said patent right, terminates as of the date manufacture and sale of the green emissive long afterglow pigment such as "EZCG Series" and secondary products containing the same.

Nemoto & Co., Ltd. will continue to take appropriate legal measures against the infringement and potential infringement in countries and districts where the Company holds valid patent rights.
